      Nothing in these Terms and Conditions shall operate so as to exclude or limit the liability of either you or Espresso for death or personal injury arising out of negligence, or for any other liability which cannot be excluded or limited by law.

  9. Products and Services

    All products and services mentioned in this site are subject to availability and are available at the sole discretion of Espresso. Furthermore, all references to products and services are intended to apply only in the United Kingdom.

  10. Software

    From time to time certain software which is the protected work of Espresso or its suppliers may be made available to download from this site. You are licensed to use the software on a non-exclusive basis only for the purposes for which it is indicated. You may not use the software for any other purpose and may not redistribute, sell, decompile, reverse engineer, disassemble or otherwise deal with the software.

  11. Indemnity

    You agree to indemnify and keep indemnified Espresso from and against all claims, damages, expenses, costs and liabilities arising in any manner from your entry to and use of the site other than in accordance with these Terms and Conditions.

    These Terms and Conditions shall be governed by and construed in accordance with the laws of England. Disputes arising herefrom shall be exclusively subject to the jurisdiction of the courts of England.

    Any cause of action you may have with respect to your use of this site must be commenced within one (1) year after the claim or cause of action arises.

    If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive and continue to be binding and enforceable.

    Espresso makes no representation that materials on this site are appropriate or available for use at other locations outside of the United Kingdom and access to them from territories where their contents are illegal is prohibited. If you access this site from a location outside of the United Kingdom, you are responsible for compliance with all local laws.

    No waiver by us shall be construed as a waiver of any earlier or future breach of any provision.

  13. Terms and Conditions for Use of the C4L Shop and Subscription Services

    If you choose to use the C4L Shop or subscribe to premium services on the C4L Website for which there is a charge, please read the Terms and Conditions for Use of the C4L Shop and Terms and Conditions of Use for Subscription Services, both of which modify and supplement these General Conditions of Use. By accessing and using either of these services, you agree to be bound by these Terms and Conditions.

  14. General Terms and Conditions for use of DVD content on a Virtual Learning Environment (“VLE”)

    Use of Channel 4 Learning DVD content constitutes your acknowledgement and acceptance of these Terms and Conditions, which take effect on the date on which you first use the DVD content. By accessing, using and or uploading DVD content to a VLE, you agree on your own behalf and on behalf of each entity and person on whose behalf you act to abide by the Terms and Conditions set forth below. Espresso reserves the right to change these Terms and Conditions at any time by emailing you and it is your responsibility to comply with any changes once you receive them.

    If these Terms and Conditions are not accepted in full, you do not have permission to use the DVD content and therefore should cease using the content immediately.

    All copyright, trade marks and other intellectual property rights in the DVD content shall remain at all times the property of Espresso or Espresso's licensors. In accessing the DVD content, you agree that you do so only for your own personal, non-commercial use. You may not agree to, permit or assist in any way any third party to copy, reproduce, download, post, store (including it on any other web site), distribute, transmit, broadcast, commercially exploit or modify in any way the material or content without Espresso's prior written permission.

    You are permitted, on a non-exclusive basis, to upload and store content from Channel 4 Learning DVDs to a VLE provided that the purpose of such upload shall be strictly for educational purposes only and only for use within schools and by school staff or pupils. It should be noted that the DVD content, once uploaded to the VLE, is not network tested by Espresso and Espresso's technical helpdesk will not support or offer any assistance in connection with any query whatsoever relating to the upload of such DVD content.

    Espresso may terminate, change, suspend or discontinue any aspect of these Terms and Conditions, in writing, at any time without notice or liability.

    In no event will Espresso be liable to you or any third party for any loss or damage whatsoever whether in action of contract, negligence or other action, arising out of or in connection with the use of any of the DVD content. All DVD content is subject to availability and available at the sole discretion of Espresso. Furthermore, all references to DVD content is intended to apply only in the United Kingdom.

    You agree to indemnify (and keep indemnified) Espresso from and against all claims, damages, expenses, costs and liabilities arising in any manner from your entry to and use of the DVD content other than in accordance with these Terms and Conditions.

    These Terms and Conditions shall be governed by and construed in accordance with the laws of England. Disputes arising herefrom shall be exclusively subject to the jurisdiction of the courts of England.
